Kysymykset, jotka toistuvat tämän roolin käyttäjillä kerta toisensa jälkeen.
When is the contractor entitled to compensation for variation work (ÄTA)?
AB 04 chapter 2, sections 3–4: the client is entitled to order variations; compensation is paid per the agreed price list or on a cost-plus-fee basis. A written order is normally required, but can be replaced by so-called equivalent variation work (chapter 2, section 4). We explain the notice requirements, assessment and burden of proof.
How is a delay penalty calculated, and can it be adjusted?
AB 04 chapter 5, section 3: a penalty for delay, normally 1 per mille per week of the contract sum, capped at 10%. The penalty is exclusive – no additional damages on top. Adjustment under Section 36 of the Contracts Act is possible if the outcome is unreasonable. An obstruction under chapter 4, section 3 (force majeure, client's fault) grants an extension of time without penalty.
What does the consultant's liability cap mean under ABK 09?
ABK 09 chapter 5, section 3: the consultant's liability is capped at the fee for the engagement (unless otherwise agreed), and only for direct loss – not consequential loss or lost profit. Limitation period is 10 years. Liability insurance is required (chapter 5, section 11). We show how caps are negotiated and what happens in cases of gross negligence.
Final inspection – what happens if the client refuses approval?
AB 04 chapter 7: a final inspection must take place at the end of the contract period. In the event of non-approval, the client is entitled to a follow-up inspection. The warranty period (5 years for defects generally, 10 years for material defects) starts on approval. We go through inspection remarks, remediation time and the right to retention funds.
How long is the contractor liable after the warranty period?
AB 04 chapter 5, section 6: liability for a material defect caused by negligence lasts 10 years from the final inspection, after which liability applies only for gross negligence. A complaint must be made within a reasonable time of discovery. We explain the burden of proof and the limitation period under the Limitations Act.
The Swedish Transport Administration and AB 04 – special state rules?
The Transport Administration's AMA system and technical descriptions (TDOK) supplement AB 04. In public procurement, LOU/LUF applies; contract modifications are limited by LOU chapter 17. We show the boundary for permitted variation work and when a new procurement is required.
