Kysymykset, jotka toistuvat tämän roolin käyttäjillä kerta toisensa jälkeen.

Just grounds for state employment – how are they assessed?

Instrument of Government chapter 12, section 5: weight shall be given to merit and skill, with skill given priority (Employment Ordinance section 4). Decisions can be appealed to the National Government Employee Appeals Board (Employment Ordinance section 21). We explain the merit assessment, interview process, and the documentation required to withstand an appeal.

Secondary occupations – when are they prohibited?

LOA section 7: an employee may not hold a secondary occupation that could undermine confidence in their impartiality or damage the agency's reputation. Section 7a gives the agency the right to order a secondary occupation to cease. Section 7b requires the employee to disclose it. Section 7c extends the prohibition for judges and certain other positions. AD case law: AD 2017 No. 22 on damage to confidence.

Disciplinary sanction vs. criminal misconduct in office?

LOA sections 14–15: a disciplinary sanction (warning or salary deduction) applies for misconduct in service. The procedure in sections 17–21 requires communication and a decision by the personnel disciplinary board. Chapter 20, section 1 of the Penal Code on misconduct in office is a criminal matter, and the two can overlap – LOA section 18 halts the disciplinary case if prosecution is brought.

Transfer of a state employee – what applies?

LOA section 12: a state employee must accept transfer to another state position. A permanent transfer to another location requires special reasons. Employees with a letter of appointment (fullmaktsanställning) have stronger protection (Act 1994:261). MBL section 11 negotiation with the union is required. We show the limits against a change to the essential content of the employment (the 'sauna bather' principle).

Dismissal and termination – special state-sector rules?

LAS applies as a supplementary rule; LOA contains no special summary-dismissal rule beyond LAS section 18. For employees with a letter of appointment, a court decision is required (Act 1994:261). The personnel disciplinary board handles the dismissal of senior officials. Instrument of Government chapter 12 and the principle of objectivity affect the assessment. We go through the process step by step.

RALS and Villkorsavtal – the collective agreement structure?

The Swedish Agency for Government Employers concludes central agreements with Saco-S, OFR/S,P,O and Seko. RALS governs the pay-setting process (individual plus local negotiation). Villkorsavtal-T (for Saco-S) governs working hours, leave, and pay during leave. We explain how the central and local agreements interact, and the peace obligation.
